
In Spain, joint ownership is governed by the Ley de Propiedad Horizontal. You can find all important amendments to the law here.
It affects areas where there are communal elements, such as lifts, pools, staircases, roofs, green spaces, etc. Among the Responsibilities of every owner is obliged to contribute to the communal costs (repairs, new acquisitions, maintenance, …). Objective: Practical property order
The Reform of Law 8/2013 has now made some changes. The aim is to provide property owner associations with a practicable ownership structure.
Among other things, it is regulated:
- Settlement of disagreements. The aim is to defuse them and prevent a split in the community.
- The liability of the new owner for debts owed to the community by the old owner is regulated.
- Every owner must tolerate renovation works decided upon by the community and pay their proportionate share according to their respective quota.
- The payment of reserves is also regulated.
- An expansion of rights for disabled and elderly people, concerning easier access to their homes, is also found here.
- Furthermore, new quorum majorities are established for different matters.
